  • online embroidery projects and stitch-alongs;
  • pre-recorded video tutorials and courses;
  • digital educational content;
  • private online embroidery consultations;
  • custom embroidery design and planning consultations.

The specific content, price and conditions applicable to each product or service are described on the relevant product, booking or sales page.

3. Prices

Prices are displayed in the currency indicated on the website at the time of purchase.

Heidi Suija operates under the French VAT exemption regime (“franchise en base de TVA”). VAT is therefore not charged unless the applicable tax status changes.

Any applicable fees or charges will be displayed before the customer confirms the order.

Prices may be changed at any time. However, the price charged will be the price displayed and accepted by the customer at the time the order is placed.

4. Orders and Payment

An order becomes binding once the customer has completed the checkout or booking process and payment has been successfully accepted.

Payment may be made using the payment methods available during checkout, which may include Stripe, PayPal or other payment methods displayed on the website.

Payment information is processed by the relevant payment provider. Heidi Suija Embroidery does not directly store complete payment-card information.

The customer is responsible for providing accurate and complete information when placing an order or booking a consultation.

A confirmation will be sent electronically following a successful purchase or booking.

5. Digital Products and Online Content

Digital products may include PDFs, patterns, drawings, instructions, stitch-alongs, recorded videos, courses and other educational or creative content.

Access may be provided by download, email, a customer account, a protected area of the website or another method specified at the time of purchase.

Some courses or stitch-alongs may be released gradually. For example, individual lessons or project stages may become available on specific dates rather than immediately after purchase. The relevant release schedule will be described on the product page.

Digital access is personal, non-transferable and intended solely for the purchaser’s private use.

Where ongoing access to digital content is provided through the website, access will remain available for as long as the relevant product and website service remain available. Unless expressly stated otherwise, purchase of a digital product does not constitute a guarantee of lifetime access.

Reasonable changes may occasionally be made to the format, hosting method or technical delivery of digital content.

6. Intellectual Property

All content provided by Heidi Suija Embroidery, including embroidery designs, drawings, patterns, PDFs, photographs, illustrations, videos, tutorials, course materials, written instructions and other original materials, is protected by applicable intellectual property law.

Purchasing a product grants the customer a limited, personal, non-exclusive and non-transferable right to use the purchased material for private purposes.

Unless express written permission has been given, customers may not copy, reproduce, distribute, upload, publish, share, resell, sublicense or commercially distribute purchased patterns, PDFs, drawings, videos, course materials or other protected content.

Login details, download links and access to paid courses or stitch-alongs may not be shared with another person.

The purchase of a digital product does not transfer copyright or ownership of the underlying design or content to the customer.

7. Personal Use of Embroidery Projects

Unless otherwise stated on the relevant product page, patterns, designs, course materials and stitch-along projects are provided for personal use.

Customers may create the embroidery project for themselves or as a personal gift.

The pattern, drawing, instructions, photographs, videos and other teaching materials themselves may not be reproduced, distributed, shared or sold.

Any commercial use of Heidi Suija Embroidery designs requires prior written permission.

8. Right of Withdrawal – Digital Content

Consumers in the European Union generally have a statutory 14-day right of withdrawal for distance contracts.

For digital content supplied without a physical medium, such as downloadable PDFs, digital patterns, immediately accessible video content or online courses, the customer may request that access begin before the end of the statutory withdrawal period.

Where the customer expressly requests immediate supply of the digital content and expressly acknowledges the resulting loss of the right of withdrawal, the right of withdrawal will cease in accordance with applicable consumer law once the relevant legal conditions have been satisfied.

Where required, this consent and acknowledgement will be requested during the purchasing process and confirmed to the customer.

This does not affect any mandatory statutory rights relating to digital content that is defective, inaccessible or does not correspond to what was purchased.

9. Private Consultations and Online Appointments

Private consultations are provided online, normally through Google Meet or another communication method specified when booking.

The duration and content of each consultation are described on the relevant booking page.

Customers are responsible for ensuring that they have a suitable internet connection, compatible device and functioning audio/video equipment for the appointment.

Any preparatory information or materials requested before the consultation should be provided within the requested timeframe so that the consultation can be prepared appropriately.

10. Rescheduling, Cancellation and Right of Withdrawal for Consultations

Right of withdrawal

Consumers who book a consultation online generally have a statutory right to withdraw from the contract within 14 days from the date of booking, in accordance with applicable consumer law.

If a consultation is scheduled to take place before the end of this 14-day period, the customer may expressly request that the service be provided during the withdrawal period. Once the consultation has been fully performed, the customer will lose the right of withdrawal, provided the required prior consent and acknowledgement have been given during the booking process.

Rescheduling

A customer may request to reschedule a consultation by contacting Heidi Suija Embroidery at least 48 hours before the scheduled appointment. Requests made less than 48 hours before the appointment may not be eligible for rescheduling.

No-shows

If the customer does not attend the scheduled consultation without prior notice (“no-show”), the consultation is considered missed and will not be refunded, subject to any mandatory consumer rights.

If Heidi Suija Embroidery needs to cancel or reschedule an appointment and no suitable alternative date can be agreed, the amount paid for the affected consultation will be refunded.

Nothing in this section limits any mandatory consumer rights under applicable law.

11. Custom Embroidery Design and Planning

Where a consultation includes the creation of a personalised embroidery drawing, design or project plan, the scope of the work will be based on the description of the purchased service and the information provided by the customer.

Custom drawings, plans and recommendations are created for the individual project discussed during the consultation.

Unless expressly agreed otherwise in writing, copyright in original drawings, designs, plans and educational materials created by Heidi Suija remains with Heidi Suija.

The customer receives the right to use the delivered design or plan for the personal project for which it was created.

12. Refunds

Refund rights depend on the type of product or service purchased and applicable consumer law.

Digital content that has already been supplied may not be eligible for withdrawal where the customer has expressly requested immediate access, acknowledged the loss of the right of withdrawal and the applicable legal requirements have been satisfied.

Consultation cancellations and rescheduling are governed by Section 10 above.

If a customer experiences a genuine technical problem that prevents access to purchased digital content, they should contact hello@heidisuija.com so that the problem can be investigated and, where possible, resolved.

Nothing in these Terms excludes or restricts rights or remedies that consumers are entitled to under mandatory applicable law.

13. Technical Availability

Reasonable efforts are made to keep digital content and website services accessible and functioning correctly.

Temporary interruptions may occasionally occur because of maintenance, updates, hosting problems, third-party services or circumstances outside the reasonable control of Heidi Suija Embroidery.

Where a significant technical problem affects access to purchased content, reasonable efforts will be made to restore access or provide an appropriate alternative.

14. Educational Nature of the Content

Embroidery courses, tutorials, stitch-alongs, consultations and other materials are provided for educational and creative purposes.

Results may vary depending on the customer’s experience, materials, equipment and execution of the techniques.

The customer remains responsible for how they use the information and techniques provided.

15. Liability

Heidi Suija Embroidery is responsible for performing its contractual obligations in accordance with applicable law.

To the extent permitted by law, Heidi Suija Embroidery shall not be responsible for losses resulting from improper use of the materials, failure to follow instructions, incompatible equipment or software, or circumstances outside its reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, nor does it restrict mandatory consumer rights.

16. Customer Accounts

Where access to purchased content requires a customer account, the customer is responsible for keeping their login information confidential.

An account and its associated course or digital-content access are personal and may not be shared or transferred to another person.

Access may be suspended where there is reasonable evidence of unauthorised sharing, redistribution, resale or other misuse of protected content.

17. Personal Data

Personal data collected in connection with orders, bookings, customer accounts and communications is processed in accordance with the website’s Privacy Policy and applicable data-protection legislation, including the General Data Protection Regulation (GDPR).

Customers should consult the Privacy Policy for further information about what personal data is collected, why it is processed, how long it is retained, the third-party providers involved and the customer’s data-protection rights.

18. Complaints

Heidi Suija Embroidery
Email: hello@heidisuija.com

Every reasonable effort will be made to resolve the matter directly with the customer.

19. Consumer Mediation

In accordance with French consumer law, after first contacting Heidi Suija Embroidery in an attempt to resolve a dispute directly, a consumer may have the right to use a consumer mediation service free of charge.

The designated consumer mediator is:

The consumer must first have submitted a complaint directly to Heidi Suija Embroidery before referring the matter to the mediator.

French professionals must provide consumers with the contact details and website of their designated consumer mediator.

20. Applicable Law

These Terms are governed by French law.

Where the customer is a consumer residing in another country, this choice of French law does not deprive the customer of any mandatory consumer protection granted by the laws applicable in their country of residence where such protection cannot legally be excluded.

The parties are encouraged to attempt to resolve any disagreement amicably before commencing legal proceedings.

21. Changes to These Terms

These Terms may be updated from time to time, particularly to reflect changes to products, services, payment methods, website functionality or applicable legal requirements.

The Terms applicable to a purchase are those in force and made available to the customer when the order is placed.
